How Long Do You Have to Report a Work Injury?

December 10, 2024 5 min read

An injury on the job can be both physically and emotionally debilitating, leaving workers not only in pain but also facing significant stress and uncertainty. Understanding the deadlines for reporting your injury is critical to protecting your rights.

Wisconsin Reporting Deadlines

In Wisconsin, you must report your work injury to your employer within 30 days of the injury occurring. However, for occupational diseases or injuries that develop gradually (such as repetitive stress injuries), the 30-day clock starts when you knew or should have known the condition was work-related.

Additionally, you have 6 years from the date of injury to file a formal workers' compensation claim with the state.

Why You Should Report Immediately

While you technically have 30 days, we strongly recommend reporting your injury the same day it occurs. Here is why:

  • Delays make it easier for employers and insurance companies to dispute your claim
  • Early documentation strengthens your case
  • Prompt medical treatment leads to better recovery outcomes
  • Some injuries worsen over time if not treated immediately

How to Report Your Injury

  • Notify your supervisor or employer verbally and in writing
  • Document the date, time, location, and circumstances of the injury
  • Request a copy of the incident report
  • Seek medical treatment immediately

What If Your Employer Discourages You from Reporting?

It is illegal for employers to retaliate against workers who file workers' compensation claims. If you face pressure not to report your injury, contact a workers' compensation attorney immediately.
